| 2 | So this is equalitySounds like the judge is purposely opening the door to the possibility of an appeal to the Ninth Circuit or SCOTUS. It would be interesting to see either court determine the constitutionality of disparate sentences based on gender. There would be no other rational reason for a judge to go on record to voice their reason to discriminate under the color of authority.
