So this case is still ongoing it looks like. The defense is making an argument that exactly references the ruling you linked here. The dispute seems to be over the story about when it happened. The prosecution says that she did it while drunk and refused to put her shirt back on til the dad showed his penis too. The drywall working story comes from the defense. Also the story originally came up during an abuse investigation that involved the kids but not the stepmom so there’s probably more goin…

I’m not saying This is okay but it seems like there’s a difference between an attack motivated by a specific hatred, and an attack motivated by her being an entitled cunt that also included something hateful being said. I think that’s what the poster you replied to meant. Sounds like she would’ve attacked this guy regardless of his ethnicity. I think a lot of confusion comes from the definition of "blacked out". To me that's different from unconscious. It means still conscious and acting, but in such a state of mind that you won't remember it the next day. Actually unconscious is "passed out" rather than "blacked out". I'm not saying either one is correct, but I think the two definitions being different to different people is the root of a lot of argument in rape cases.
