You need a warrant in order to use the fruits of the search against person in court, not to conduct the search itself. That's not what the fourth amendment says. It very clearly prohibits unreasonable search and seizure. You can use it to sue if you think you're a victim of warrantless search (though a combination of corrupt cops, corrupt judges and corrupt district attorneys makes this prohibitively difficult and generally not worth the financial effort).
