Absolutely not worth it and would try to talk out anyone considering it. Essentially betting half of everything you own on an institution that has better than average failure rates. Even if you don’t get divorced and remain together decades from now, by then you both will most likely resent each other. Divorce and my daughter were the best things I got out of my marriage. Definitely urge you not to roll the dice by assuming your relationship is somehow more immune to such eventualities.

Don’t let the fear of her throwing another tantrum compel you to delay initiating the divorce. No offense, but you sound like you’re afraid of her. She sounds like a miserable person who enjoys making you miserable. You should tell her, “I’m divorcing you” with the biggest smile on your face. Get away from that horrible person as soon as you can and start being happy again. Life’s too damn short. Good luck.

You’ll have to assume the loan in order to get her name off the loan. Being allowed to assume the loan is at the discretion of the lender; they do not have to allow you to do so. If the do, same rates apply. If you are not permitted to assume the loan, you’ll have to refinance under new rate and terms. In either case, she will have to sign and file a quitclaim to the property. Good luck!

I really don’t see the point in marriage. You can be in a fulfilling relationship without it being government sanctioned only to need lawyers brought into it afterwards to dissolve it. Seriously wished that I never got married and wasted so many years and would absolutely never do it again. And I say that despite that I am now in the best relationship that I’ve ever been in.

I’m not sure your kids would appreciate that you and your wife decided to stay married and miserable for their sake. You’ll be teaching them how to stay committed in toxic relationships. Would you encourage your kids to remain in a relationship that made them depressed and miserable? YOU deserve to be happy and your kids deserve to see you happy. I promise you that your kids will be fine. Get a divorce already and start enjoying your one life.

As others have stated, she wants nothing to do with you but has no problem with you continuing to pay and support her. Don’t be a fool! She’s done with you so get divorced while you have assets remaining.

There’s a better than average chance she feels the same. If you can work it out, great. If not, divorce and move on. All the better that you’ll be financially stable. Sometimes losing money and abruptly changing your lifestyle is the cost of entry to happiness. I was 49 when the divorce was finalized and wish I did it sooner. If you are feeling that way now, it’s unlikely your view will improve with time. You owe it to yourself to be happy. Good luck.

I wouldn’t recommend it. You are required to disclose ALL assets in the process. Not doing so would be fraudulent. You friend can do whatever he wants, but just understand that courts would not look favorably if discovered.

You’ll also need to file a quit claim to the house. This is a simple legal document that you, as the name suggests, will not make any claims on the house (eg, if the house is sold). Since she is getting the house, recommend that her lawyer prepare the document and she or you both share the preparation and filing costs. Good luck!

My ex assumed the mortgage as per the divorce decree. This did not adversely impact my credit report at all and only helped in securing my new mortgage because I was no longer on the previous loan. An ex assuming a loan is not as common as refinancing the mortgage but it is still a common way to divide marital assets. Banks and lenders are very familiar with this. For me, it was more important to be off any loan I shared with my ex after the divorce.
