Thinking about it, it seems like rather than saying universally a marriage equals a certain percentage of entitlement regardless of verbiage, maybe it'd be better to have a "unless stated otherwise " rule. A will should certainly overrule a marriage when dividing assets, because it's the right of the deceased to state where their assets should go. 0	That's too bad... My opinion is that if she was the guys spouse when he died, then she should get SOMETHING from his estate even if she wasn't written in. The marriage itself should serve as entitlement to something. Maybe not the whole estate because he had other family to take care of, but if the two of them were willing to get married legally, that should show some sort of obligation to one another and should be respected.
