He didn't make incriminating statements though, as to the charge of rape. He made unconvincing statements in the judges opinion, that's the point. The judge did not say or imply that he had either, simply that i believe his version on this point is not legitimate, but hers is. This should be a flatly negative outcome unless you accept the loss of human right to a presumption of innocence until proven guilty, and prefer via a change of judicial system to instead ensure less guilty people go free by having more innocent people routinely go to jail. I just read it all, did not change anything. Helpful in seeing what the final version of agreed upon and disagreed upon details were, but mostly or completely leaves out any mention of her changing story throughout the process. My ex's father got 1/3rd that amount of time for being caught red handed by witnesses engaging in pedophilia with a young child. Densmore gets 3 years for a "he said" "she said" case with 2 adults that engaged in at least a partially consensual sex act where the victim changed their story a bunch of times and absolutely lied multiple times including about injuries sustained.

Because he isn't being charged with any sort of filming crime, if that is even a crime in canada, the purpose of the video is largely irrelevant, getting so hung up on it is ridiculous. I think the key thing here is that she changed her story from a more standard rape description that left out a lot of things that ended up being established by cross examination of both witnesses later, and morphed her story into what you just described. If this had been her story from the start and she always stuck to it, it would be better, but still lacking any real evidence. The consent video should be irrelevant for several reasons. For one, the charge is rape, not filming without permission.
