But actually that is EXACTLY what the first amendment means, the speech is "protected" from action from the government unless it's slander or libel. If it is slander or libel, it's not up to a family court judge to make the ruling, especially on no evidence, which if you read the transcript you would see there was none presented that would determine it was either libel or slander.
