Great advice, they often want to be seen as victims even when they are the offender. That manipulation can lead to trouble for you. My ex would do some nasty stuff then I’d get pissed and she would accuse me of mentally abusing her. So I couldn’t get angry or really question her actions in any way. Luckily for me it didn’t last long when things got to that point. Also mind that asking questions in a way that isn’t polite is mental abuse. Arguing can land you in jail.

If you have a cohabitation clause in your separation agreement it’s definitely possible. Alimony is usually negotiated and it really depends on the separation agreement. It can be variable or static for n years. For example my alimony steps down every year and of she gets married it’s done. Read your separation agreement carefully.

Ive asked and the answers are ambiguous and not straight forward. The reason I want to know more is that I want to get more time with my kids and I need the additional financial resources to make that happen. I divorced in Colorado last year 2019. The new tax laws suck! But my lawyer added a multiplier into the worksheet to adjust for the tax bull shit. As far as I know maintenance can only be changed if you choose to not lock in the amount. This choice is usually explicit in the agreement. You need to check. In either case child support can be modified as far as I understand. It’s crazy that someone who’s capable of working gets maintenance in this day and age.

Which ever way you go you should have a formal separation agreement laying out in detail what each of your responsibilities will be moving forward. You would still pay child support depending on how many overnights you have with the kids and your income disparity. Just finished divorce in CO. I used modern family law. They were great but I ended up spending 15g for a 4 hour mediation session. If your ex has a lawyer you should get one as well. UPDATE: judge has refused to allow a vocational expert. This means we cannot get an expert to evaluate my wife and determine her employment potential. Judge stated that the court can adequately asses her income without an expert. Also the court recognizes she’s under employed. Unfortunately this puts my case in a precarious position. Now it’s completely up to the judge to decide and leaves a lot of room for interpretation.

My experience; when a woman loses interest, even for lame reasons, there’s nothing you can do to change that. In fact the more you try the less interested she will be. Depends on your situation. In my case my wife initiated the temp orders to get money from me. If your fighting over finances this is a good chance to impute income but you must be prepared with vocational expert. If it’s regarding custody it’s more complicated and you should try to get 50% up front. If you think she’ll fight you or try to keep your kids away fight for equal custody.

Simple. Make sure you are making a similar income as your spouse. Most states have a calculation you can look up to determine where you need to be. Your kinda fucked on your assets. Marital assets will be split 50/50 unless you can shelter them somehow as others have suggested. It’s quite difficult to shelter assets because there’s always a trial. Sometimes it’s just best to let it go and move on for your own sanity.

Not sure about this approach. Her business isn’t worth much but what little income she makes comes from it. Though she’s spending almost as much as she makes. At least that’s the way she reports it on taxes.

I’m going through the same thing. My “ex” has a business that grosses $70000 a year but she claims AGI is only $20000. Also she has a undergraduate degree from a prestigious university. In temporary orders I tried to impute income of 50g to her but we did not have enough evidence and or information that she could and should be making at least 50g a year.
