It's when it's turned into laws that it causes issues. Imagine if every slighted wife could retroactively accuse their husbands of multiple counts of rape and sexual assault because of this stance on affirmative consent. As a result some people feel uncomfortable saying an overt no in case the other party becomes violent, and others want an overt yes both so that they don't cross boundaries when they don't mean to and also so they can't be accused of purposefully doing so. The thing about an intimate relationship is that you are aware of that person's personal boundaries.
