Home EquityShe's going to refi without me. | /r/Divorce_Men | 07/07/26 11:05 AM
Home EquityShe won't, we'd have to sell. She refuses to live in an apartment. I'm not crazy about the idea, but I'll do it anyway. She would need the equity to buy something else. | /r/Divorce_Men | 07/07/26 12:24 AM
Home EquityDo you have a legal document? | /r/Divorce_Men | 06/07/26 07:19 PM
Home EquityI'm worried about that. That's why I'm trying to piece all of this together. | /r/Divorce_Men | 06/07/26 04:42 PM
Home EquityI found it after I posted. It's called a Duke Order. I come off the loan but stay on the deed. There's a set amount of time then it's either sold or bought out. There's also a tax provision that allows me to be considered living there even though I'm not due to the divorce and not have capital gains tax on the money. | /r/Divorce_Men | 06/07/26 03:45 PM
Home EquityThere's an option called a Duke Order. It's a legally binding order where she refinances, I come off the loan and I stay on the deed. There's a set time, when our youngest graduates, then the house is either sold or I get bought out. There's also an IRS code that allows me to not have to pay capital gains even though it won't be my primary residence. I understand what you're saying, I'm just trying to do what's best for my kids and explore all options. | /r/Divorce_Men | 06/07/26 03:35 PM
Home EquityI don't think so, between the rates right now and the added $150k the payment it will be to high. I don't want her being house rich and cash poor for the kids. | /r/Divorce_Men | 06/07/26 03:31 PM
