What 4agreements said. If she has no intention of moving she shouldn’t have a problem with it being part of the agreement and decree. Then you’re locked in. Similar situation for me. Add 3 hours to that distance though. She didn’t want a residency requirement at all then found out that it was standard in our county in NY. Then a school district was added. She doesn’t move the kids without my approval or a court order.

I had a similar situation. The above post is spot on. I put together a spreadsheet detailing what an “equitable distribution of assets and liabilities” would look like. Consider all cash’s and real assets and liabilities. Don’t forget retirement and life insurance. Try your best to be fair. Take some, give some. Come to agreements as best you can between you two. The way we did it (I find it odd that she told them without you there) was to explain to the kids that the one of the most important jobs we have as parents it to teach our children what a loving relationship is. The issue is that the debt is considered marital if it was incurred during the marriage. You’re likely going to be responsible for half. I’d advise you getting alot of this worked out before getting a new place, furnishings Evy so you know what your overall financial situation looks like.

Everything comes in the form of a contract. Once she signs the divorce agreement which should include full financial disclosures. I’d have the lawyer put in the agreement that the cash you’re giving her releases you of any claim against any financial asset (401k included)

Be honest without telling them whatever details exist. For me I said that Mom and I don't love each other the way we should anymore. They cried. My ex and I told them that we know it hurts but all of our lives will be better for this in the long run and that we both love them more than they can imagine and whatever happens they will always be first in our lives. Mine were 8 and 10 so a bit older.

I just signed my agreement in NY. There was an additional document we signed that stated that nether of us will qualify for the other's insurance. I'd be shocked if it were different elsewhere.
