It's less about the justice system and more about rape being extremely difficult to prove or disprove It ultimately comes down to a he-said she-said in the majority of cases, rape kits are infrequent and even then can be contested with the argument that sex was consensual, and if the accused has priors and it comes down to letting a potential rapist walk or not, they're going to lean towards putting them away
