If you are in a small jdx it can help or hurt because it is usually the same attorneys appearing in front of a few judges and most times the attorneys are known to the judges. (CA)In MOST jdxs the date of the end of the marriage is the date of service, not the date of separation, but it can also be agreed upon between the parties. HOWEVER, there are various reasons an attorney may put the date of separation as earlier. Likely at the temporary orders hearing they will ask her attorney what she would like as far as a parenting plan. You didn't say which state you are in and whether your state is a 50/50 state.
