This can be very jdx dependent. Some jdxs require a "wet" signature or initials on every page, some do not. The rules on this are changing pretty rapidly because of esigning and individuals and atty's being remote. Notaries are being phased in some jdxs. I do family law mediation and I am a family law attorney. In general, if we are talking settlement or I am doing a mediation, I will do parenting time or property first. Until one or the other is settled I try not to move to the other. I prefer parenting time first because once you get that emotional hurdle over with it is easier to do property. I think it depends on the jdx. If you are in a small jdx it can help or hurt because it is usually the same attorneys appearing in front of a few judges and most times the attorneys are known to the judges. In a larger jdx this won't be the case. In general though, if your lawyer is prepared and is following the rules and statutes judges will be grateful.

Go to rehab. IMHO Gambling addiction is one of, if not the hardest adddiction. I have watched people go down again and again. And you understand right that you can self-exclude but go in anyway and gamble? It's just that if you win you don't collect the money. Gambling addiction has nothing to do with money. One of my good friends is several years clean from a gambling addiction and said this "the actual high is the PLANNING to go gamble" Made a huge amount of sense to me.

You can appeal but the standard is whether there was an abuse of discretion and those are difficult to win. Yes, you could end up paying her atty fees on appeal.

In most jdxs the only distinction between a legal separation and divorce is that you can't get remarried. All property is divided, if you have children, parenting time and legal decision-making is decided, child support is ordered. The only difference is that you are not divorced. I've been practicing family law for a long time and this has never happened to me. Honestly, it sometimes TAKES 30-45 days for the withholding order to get into place...that is craziness

Ok. Then go to the hearing and argue. I practice in a state that has the same law, but advise every one of my clients to pay until the wage assignment goes through and keep track of it.

I get that, but you knew it wasn't coming out of your check. You could have paid with a check so that you could track the payments to show the AG that you WERE paying. You can certainly argue that they didn't set up an account for you, but ultimately it is your responsibility to get the child support paid. It sucks, I know, but never trust the government to do things for you.

You can file married but separate. If your divorce is not yet final and you owe because she will not answer your requests, you can ASK for her to pay part of the taxes. If SHE files married but separate and SHE owes, it will probably be a wash most likely. If either of you get money back it will likely be split in the divorce. In most jdxs there is an injunction that gets issued at the beginning of the case that precludes either party from removing any insurance until the decree is signed. What insurance (medical, auto, homeowners) is included varies by state but if you do this you could be subject to contempt. Ask your lawyer before you do this.

Just a couple of things. There are no jury trials for divorces in Florida or most jurisdictions. The trial will be before a judge. In MOST jdxs the date of the end of the marriage is the date of service, not the date of separation, but it can also be agreed upon between the parties. HOWEVER, there are various reasons an attorney may put the date of separation as earlier. As other posters have said it might be for a raise that happened after that date which would affect child support, spousal maintenance OR retirement accounts and 401k's.

If it's a 50/50 state then she is just being unreasonable. Judges see this stuff all day long. I've been doing family law for a long time. She is trying to get a reaction out of you. Don't give her one. Just remain calm in court and let your attorney do the talking. You will maintain your credibility and in the end you will probably get what you are looking for. Common bs. IMHO Judge's don't like this playing around stuff. Likely at the temporary orders hearing they will ask her attorney what she would like as far as a parenting plan. You didn't say which state you are in and whether your state is a 50/50 state. In some states unreasonable behavior is ground (after looking at the respective parties resources) for attorney's fee awards. Let her be unreasonable. It's all for the good for you in the end.
