Waiters here make a fraction of minimum wage, they work for the rest. Where you're from, the food is just more expensive and they have a higher hourly (I assume). The tip means the waiter works for the extra amount, rather than it being guaranteed. If it's guaranteed then they're allowed to be lazy and get paid the same. Kitchen staff should be making 7.25+/hr (federal minimum I believe). Waiters make 2.13 because tips is expected to make up the difference. If tips don't make up the difference, the restaurant is supposed to change their rate to match 7.25/hr. It's an expected part of the exchange when you sit down at a restaurant over here.
