It appears in dictionaries because enough people weren't corrected when it started being used that now dictionaries have to explain what it means (because that's the purpose of dictionaries, to look up meanings, not police what words are used). Look up the differences between 1st, 2nd, and 3rd wave feminism, it may have started out being about being egalitarian, if not a little racist, but it has changed. People are generally either ignorant of the consequences in the first place or have convinced themselves they won't get caught so they don't really care. Idk about rape law in particular, but German law doesn't generally "remember" your crimes after your penalty.
