Consult a CPA first. IRS generally won’t wade into filing status disputes between couples. Your best route would have been to get it back in the divorce decree. Now you’re looking at spending a lot of attorney fees to get the case heard. Probably not worth the effort. Also, don’t just go and file an amended return. IRS will flag it immediately since she filed with another status. Then you’re looking at an audit.

Inputs included size, how long you last on average, how often you go (weekly I think you said) and convert it to miles. Not sure about that. If she wants sole custody and is out abusing drugs or alcohol, the judge usually will take that into consideration, same as if the father was abusing. Have your lawyer subpoena the videos. First off, it’ll make her lawyer facepalm. Second, he might advise his client to settle rather than go to court. Start finding a lawyer behind her back. If she’s turned down rehab and other forms of therapy, she’s a lost cause until she hits rock bottom and wants to change. Couples therapy was throwing money down the damn drain for him to focus on everything I did wrong while giving her a free pass to treat me like shit. I eventually told him I was no longer going to let him to do that and stopped going.

Yeah you need to get an attorney yesterday. Reach out to a few tomorrow and get consultations. Absolutely file first. Be on the offensive and set the rules of engagement. Court will view what she did as abandonment. You might have been eligible for spousal support since you were a full time student but with that ending, who knows. Don't reply to the email. Let your lawyer do it. Are you certain it's inheritance? IE from a dead person/their trust? Or is it from a living person/trust that's trying to distribute money each year as a gift to keep below the gift tax limits? If you have proof, you should be fine. I would have the police there when you serve him. Have bags packed for a week or so stay with your kids at a family or friends. Don't leave anything to chance. And don't do this on the cheap. Don't trust her. Get a lawyer yesterday. Don't get the first one you talk to and vet a couple. I'd recommend you read the book "The 10 stupidest mistakes men make when facing a divorce." This. They get hit with the gift tax and it will impact how much of their estate they can leave to their daughter without hitting estate tax. I'm assuming they have a sizeable one since they're handing over $4k a month.
