Mine was able to get 50% of my TSP as of an agreed upon date. I paid her in 1 lump sum without penalty. Other than losing $140K. Then she’s entitled to 1/2 of my retirement for only those years we were married while I was a fed. I was a fed for 11 of the 20 years we were married. Hope this helps.

I’m right there with you. Imma Fed. She gets half of my federal retirement and I’ve already given her half of what was in my 401(k). All of that stuff I get and I’m OK with. It’s the continued spousal support while she lives with another guy in a brand new home, with a swimming pool, and drives a new car every two years.

Thanks for the feedback. Cohabitation is NOT mentioned in my agreement, but remarriage is. However, VA law does mention cohabitation. “Upon order of the court based upon clear and convincing evidence that the spouse receiving support has been habitually cohabiting with another person in a relationship analogous to a marriage for one year or more commencing on or after July 1, 1997, the court shall terminate spousal support and maintenance unless (i) otherwise provided by stipulation or contract”…

Thanks. Proof is not going to be hard. They bought a house in Florida together. Which is great. He’s a good guy and they seem happy. I just don’t want to have to pay her $2K a month after taxes for another 6 years.
