don't fight the "individual privacy" angle, fight it on an exploitation level. While it is, in certain jurisdictions, completely legal to photograph someone in a public place as they have no expectation of privacy, it is not legal to use that image for commercial gain. Commercial use of a photo generally requires a model release. gender and race are not protected under the law. there are however, protected classes of people with those classes defined by their gender or race. For instance, it is illegal to discriminate against a woman or a black, but it is not illegal to discriminate against a man or a white. If you are a white male (under 45) you are not protected by anti-discrimination legislation (at least not federally).
