No, sir. You do not get a DUI automatically. They will arrest you and keep you under suspicion of impaired driving. Refusing their tests forces them to get a court order for them to legally obtain a biometric reading that definitively tells your BAC. The reason lawyers tell you refuse is that the time between your arrest and when they get the court order could be hours and by then you will below the legal limit.
