Sauce - family law attorney. If there are no kids and little or no debt and amicable partners, yes, divorce court just would needlessly extract money from the marriage. But you almost never see those things happen in divorce court because those divorces are done by agreed orders entered ex parte with no appearances. The reason divorce is so financially burdensome is usually that the marriage carries more debt than can be serviced at the same time as two households. Starting a huge legal fight ov…

With your question as asked, I'll take the 28 y/o virgin hands down. But the question isn't very fair. You've given the 21 y/o a high n-count and a clubbing propensity, but the only thing the 28 y/o has "going for her" is being a virgin. I don't want to have to teach my 28 y/o wife how to fuck. I bet if you changed the prompt to something like: 22-year old (right out of college) who slept with 20-25 people between 16-22 and went clubbing a few times a year, but is ready to settle down. vs. 28-ye…

This is their theory, yes. Prosecutors apply this theory equally to false domestic violence reporting. Curious that it's a crime (at least in some jurisdictions) to interfere with domestic violence reporting, but apparently de facto not a crime to falsely report it.

Jesus the answers here are bad. Its likely not perjury unless she maintained the lie in court. Lying to the police is not perjury, its making a false statement to a law enforcement offficee or obstruction or false reporting, all three of which are crimes. I have had DPAs tell me they refuse to file false reporting charges on rape "victims" after we get their claims dismissed. Because of the "chilling effect" they say...

Here's mine: First semester of undergrad; I had just finished AP calc in high school and this girl I knew through a couple classes was taking (and struggling in) calculus. 10 PM I get an instant message asking me to come to her dorm and help her with her calculus. I show up and she invites me to lay on her (twin long) bed with her. I did. And I showed her exactly what she was doing wrong and how to properly set up her equations to do her calculus homework. And then I left.

My brother and sister in law practice NFP for religious reasons. They are quite diligent - charts and mucus inspection and whatnot, so I suspect they are probably practicing it as effectively as possible. They have two children under two years old. Even assuming perfect practice, NFP is among the least effective methods of birth control. Natural Family Planning = Planning for a Natural Family.

Forget India... this is the situation in the United States. The US version of 498a is called a DVPO, and it is absolutely used as a sword instead of the shield it is intended to be. Granted, we have much better protections about unlawful search/seizure and more reasonable principles of liability (re: charging relatives)... But... eviction from the family residence is something that is 100% on the table in a divorce action. Court can also award the petitioner the use of your car.

I concur - doesnt seem to be an issue here because her current "catch" doesnt seem that way on paper. But I think with the cautionary tale should be more recognition that the optimal strategy should involve some level of hypergamy - just not unchecked or recklessly done.

It sort of was once - I recall reading in one of my philosophy texts of an admittedly tongue-in-cheek response to the proposition that God was simply defined as the greatest being imaginable. The response was that one could imagine a being with all the properties of God, who created the universe, yet did not exist, and that such a being would certainly be greater than the same being who did all those things but did exist. But aside from the obvious application to the problem of evil, the argumen…

I would concur that it has been defined down over the years, and perhaps especially so within the last ten years. I remember when I left high school, a "serial monogamist" was someone who went from LTR to LTR with little time in between. It wasn't really insult or praise - it just described what that person did. But then by the time I finished college, a "serial monogamist" was someone who went from STR to STR with little time in between, and the phrase picked up a somewhat pejorative connotatio…

Reminds me of another case where a doctor told the patient having sex with him would cure her ailment. Obviously it didn't and she raised a stink about it. Verdict - morally reprehensible, but not rape or battery because she gave consent.

This is seriously an idiotic idea. Why would someone go the whole false trans route (which would moot the case when discovered and result in dismissal) when there is already a perfectly viable mechanism?? It's a straight up Title IX denial of equal services. Assuming, of course, the school is in the US and receives federal aid. I only know of one school in the nation that doesn't.

Maybe law school is a bit different in the PNW then... I could see this at CU for sure - there were a handful of girls like this there. But it was not my experience after leaving CU. I guess my point is not that you should date women in law school. I knew very few of my classmates that were dating law students. But I knew plenty of them who were hooking up with each other.

Where? Mine sure was - both of them were. And of course it will depend on the institution. You're not going to find a target rich environment at Pepperdine, though you might in Malibu. Most of my friends are grads of SU, CU, UW, Gonzaga, or L&C, and their experience was the same as mine - even at SU, which prides itself on being a "social justice" university. I want to stay, but I know the smart decision would be to go. I feel like I'm thinking with my dick atm. Then think with your dick some more. Law school is filled with intelligent, hot, single women. Law school is also where pre-existing relationships go to die. And finally, nobody in law school has time for a committed, stable, LTR. In short, law school is prime ground for meeting hot, smart women who are single (and often recently so), and who want sex, but have no time for a relationship. It'…

Why exactly is this the case, though? Also, what exactly are the exceptions to this? Ankenbrandt v. Richards, 504 US 689 (federal courts lack subject matter jurisdiction for family law cases). The only exceptions are cases from US territories and the Supreme Court (because it has appellate jurisdiction from state courts). SCOTUS rarely takes them though because they don't like handling issues of purely state law. Who exactly makes a question about this occur in the first place, though? Poorly wo…

That's certainly not true for federal courts, correct? Correct, but federal courts almost never hear family law cases. Federal jurisdiction only extends to enforcement. So, all judges need to do is find implied powers, correct? Indeed, even original intent doesn't have to be relevant, correct? After all, as far as I know, not all judges accept the premise that judicial interpretation of the U.S. Constitution should be based on original intent. No - not correct. Implied powers only come into play…

Can't courts find jurisdiction for certain cases, though? After all, I know that some people have argued that the U.S. Supreme Court had no jurisdiction to hear Bush v. Gore but nevertheless heard and decided this case. Also, though, can't courts give themselves new powers? After all, as far as I know, this is what the U.S. Supreme Court previously did with the power of judicial review back in Marbury v. Madison? Kind of depends on the state. Many state courts are legislative entities, meaning t…

Even if it is unheard of, though, is it actually impossible? After all, there certainly is a difference between "unheard of" and "impossible." It would depend on the law - otherwise there is no basis for jurisdiction over the issue. Not to mention no live controversy. No--rather, I want family law courts to properly do their job. So you really just want family law court reform. What if there was no previous court order to pay child support, though? What if the support from the custodial parent w…

Can't courts get involved in matters which they are not asked to get involved in on grounds of public policy, though? Also, what about if one's insurance company refuses to pay up? Can a court intervene then? Yes to both questions, but only after the contract has been challenged. It's unheard of for a court to have to ratify a contract. About the only similar thing I can think of are when courts approve or reject a settlement in civil suits. Couldn't this screw over the man by forcing him to pay…

Happened when you were drunk, high, drugged, or passed out and unable to consent Just a side note on this... I agree it's poorly worded, but from a legal perspective, what it likely means is (drunk or high or drugged or passed out) and unable to consent. I.e. - incapacitated and unable to consent because of the incapacity. And really, from a legal perspective, the reason for incapacity is irrelevant. Consent is the controlling factor. Now, whether voluntary intoxication of the victim should be a…

No, though not for the reason you would expect. Such an insurance contract would almost certainly need to name the putative father as the beneficiary and not the child. Why? Because of the problems with having un-named beneficiaries in insurance policies. If the man is the beneficiary, then the contract is solely between the man and his insurance company, and the court has no place in the arrangement unless one party sues to enforce (or not) the contract. Moreover, if the court was somehow requi…

Having lived in Seattle, I wouldn't be surprised to discover this girl is from the Midwest or Southeast. People in Seattle treat everyone this way. For whatever reason, to someone from the Midwest, Seattleites are extraordinarily rude. No - because it would still boil down to a social study about how social studies are unscientific. It's just particularly amusing that the individual heading the study was liberal, and concluded that it was liberal bias that undermines his field of work.

women tend to be more genuinely accommodating, trustworthy. So you've said. Where is the basis for this? All we see in this thread are cherry-picked stats. social work requires that you enjoy helping others. beyond logic, computer programming requires more working alone, which antisocial types are more drawn to. Like any other profession, social work does not require that you enjoy your job. Just because many people who already enjoy helping others doesn't mean that enjoying it is required to be…

what percentage of men are social workers? why do you think that is? what percentage of men are computer scientists? why do you think that is? You're making my point for me now. The genders are different. Here, the difference is explained by the brain development during puberty. Women retain more of the tissue in the corpus collosum, which lets the hemispheres of the brain work better in concert. Men lose some of this tissue during puberty. Thus, women are more likely to use the halves of the br…

I never said they were - just pointed out a glaring flaw in your analysis. Perhaps a better way to go about finding stats to support your opinion would be to look for which gender is more bound to their word and does more altruistic things for others. Maybe the genders are equally evil at heart and one does a better job of overcoming it. My point is that if you want to point to data, you need to find some way to account for underlying socialization aspects of what you're trying to examine. Here'…

The act of refusal is not criminal in and of itself. However, even if you refuse to blow, the State can usually proceed as an "affected by" DUI, meaning that your driving was appreciably affected to some degree by alcohol. If you were pulled over for equipment malfunction (e.g. brake light out), you might be fine, but if there was any sort of moving violation, you can still be convicted of DUI, even if the State never shows you had above a 0.08. As for the suspension, that's usually administrati…

I don't think so... I mean, at it's core, FN's concept of religious asceticism is essentially the denial of inherent natures. "Piety" results from averting oneself from hedonism and suppressing the "old brain." IMO, in this context, it's hard to tell whether it's alpha or beta to practice something like asceticism. On the one hand, some of our baser instincts are undoubtedly more alpha traits. But on the other, having control over one's actions and instincts is also an alpha trait.

Even a pre-nup won't save you - courts are free to toss them if they want to. Premarital contracts are not tossed away freely, especially if you are in a UPAA state. They are tossed, however, if they are unconscionable or the product of fraud, duress, or some other type of coercion. The most common ground for tossing a prenup is where (1) the wealthier party did not disclose assets, (2) the poorer party did not waive disclosure, and (3) the poorer party did not have independent knowledge of the …

Lawyer here. This document doesn't hold water at all. Let's take a look: The largest, most glaring, problem is section 9. Child support is a right of the child, not the providing parent, and absolutely cannot be contracted away by the mother or father. Also, with section 9, the notion that a contract (especially without consideration) could limit a woman's choice about her own medical care is laughable. The second issue are the sections concerning duress. Ask yourself this - if there were a situ…
