Really what are you doing in HR? HR isn't to assume actions, that puts them into bad situations. It is to foresee such incidents form damaging the company morale and image. Guy can be put into a bad position where if you discipline them and they don't like it, our society favors the woman. Sure it can be visa versa too, you could use your power role on her. That is why the law quid pro quo came about. Lots of reason she would say that, the least of the intention is a double standard.

If woman are absolve of their consent when drunk then drunk driver should be absolves of their action when driving drunk. Get that logic? it's the same, think about? I do not support that. I just wouldn't call it rape. I think it's still wrong but it should be a civil matter not criminal. I think that is akin to saying "he asked several times after I said no if he could kill me...I finally gave in and said yes." There is not logic in that. Person doing the killing is wrong, but he's not a murder, it's assisted suicide. That how ridiculous the other sounds, they can walk away from the situation. That puts it in there hands as much as the guys.

Well only if they actively participate in the sex, then yes I agree. Just to be clear just so I don't misunderstand you though, drunk or not, rape is rape. If you choose to get drunk and get rape, that's not your fault. But if you choose to get drunk and "fuck" someone, that is your fault. I agree there.

Yes. Consent can be withdrawn at anytime regardless of "circumstances", No is NO. Withdrawing consent is still a NO and if someone continues then yes that deserve criminal punishment.

Still an issue, why should the the question not not be asked to him? If she had sex with him too isn't she sexually assault him you? I would argue this: If two people actively participate in sex, and consented, then they are both having sex. That is not rape. Under Canada Laws If two drunken people actively participate in sex, and consented, then they are both having sex. This is considered rape by the man. Because I guess only men have sex and woman are just taking it. Think about that.

True...I did say that it is unnecessary now, and arguing why it's evil or not isn't productive anymore since I agree that it should be phased out, and as people take the roles of medical heads from each subsequent generation you will see those changes.
