To keep it simple jail is for light crimes and prison is for heavy crimes. So with your example it's not exactly black and white, there are unknown factors to the story. Is the person who split their head open the one who started the altercation, is the victim old/young, is race/religion/sex/sexual orientation a motivating factor for the assault, etc. With that said, if the victim were to die from the altercation. The perpetrator could be charged with felony assault. But it would ultimately come…

Felony is a crime that is more severe than a misdemeanor. The minimum punishment is one year in prison and can escalate all the way to a death sentence. Misdemeanor carries a punishment of 364 days in jail or less. Edit: Felons also lose the right to vote, must disclose the fact that they are felons on job applications, and are not allowed to own firearms.
