I realize it sounds a bit pedantic, but to me that's basically the crux of the issue. If the laws were obviously discriminatory towards fathers, then it would be reasonably easy (or at least straightforward) to argue for change. But since the "fix" requires a fairly significant shift in the mindset of society (and the old guard of the legal system --judges are overwhelmingly old men who are statistically more likely to believe in traditional parental roles), it is much harder to tackle.
