Like I said and others have said, the burden of proof in a civil case is not very high. You're right, in a criminal case just having open wifi is just about enough to get you off. The civil case is just looking for a target and getting them in the courtroom. Remember OJ bro. It is not debatable that the IP can be tracked to a physical location. Even if the real perpetrator is on their wifi, or using TOR, or they break in every single night and plug in to the router.

Route trace/traceroute is just nit-picking. I agree with you on most things you said otherwise. BUT, I must add: ever hear of people getting a letter from their ISP for torrenting? That's an actual example of this working. Watchdog company gets your IP and notes the date/time submits the info to your ISP and then match it up to a customer and send the cease and desist letter. While it's not ALWAYS this simple, a majority of the time it is.

He's not talking out his ass. As long as the ISP cooperates (which I feel it shouldn't without a subpoena) they'll be able to find the at very least the household it came from, linking it to places of employment as well will give them a target for the lawsuit. I could file a lawsuit against any random person, doesn't mean it'll stick. So please shut up unless you're going to tell him why he's talking out of his ass.
