Sure, those are all reasons she might be in hs at 19. But they don't in any way increase the odds that a girl in hs is 19. He was still gambling on a statistically highly unlikely scenario, and he gambled wrong.

I don't know how I can stress this enough. In the news article tho post was referring to, it was not a normal interaction. I cannot speak to someone getting stat rape charges when they meet someone in a bar, because I think context is needed. I personally think that in general, that's a shitty application of the law and that over time it will remedy itself. But that's not what happened in the case being discussed in this post.

Really? There are no physical differences between most 15 year olds and most 19 year olds? I sincerely hope you are yourself a high schooler, because if you are then I believe that this is a reasonable comment. But I promise you once you reach even your mid 20s, you'll look at (most) 18-year-olds as children.

I think the point you are trying (and failing) to make is that there are high schoolers who meet Australia's age of consent requirements. My response to you is: that obviously is not enough. There were good odds that this girl was underage, and this dude rolled the dice and lost. In normal society this kind of thing doesn't happen very much because normal people don't fuck strange high schoolers off the internet.

Right. Which in every western legal system I know of is not a fully legitimate defense. What if she was 13 and said "I'm 19"? Does he get off then? 11? 9? this isn't like this is some grey zone where the guy met her at a bar where she was slugging back whisky and smoking Marlboros. He picked her up at a library. She was in a school uniform. He was the clear adult, and had an obligation to determine if she met the age of consent. He chose to ignore this, and now he is facing the consequences.

Okay. I'm not saying 100% of the time someone looks there age. But odds are she probably didn't look 19, and more importantly, she was an admitted high schooler. The 46 year old adult should have had the sense to verify her age. He didn't. He goes to jail.

I do too. But there's a pretty large physical maturity gap between most 15 and 19 year olds that is less self-evident in your early 20s. Plus, again, he knew she was a high schooler. The odds were stacked against her telling the truth.

Sure there are. And they comprise what...1% of the high school population? The vast majority of seniors in Australia are 17 or 18. If I'm about to bang a girl who I literally know is in high school still, do you think it's smart for me to trust her claim that she is a statistical outlier? Or perhaps I could take the 30 seconds to verify her age via some form of documentation.

That's a little dishonest selective quoting. The dude picked her up from a library and she was still wearing her school uniform. It wasn't "she lied about her age" so much as "he willfully ignored all signs that she was lying about her age."
