Depending on state texts can be used for a lot of stuff. Since alimony is forfeited in my state for adultery, I was able to get my lawyer to subpoena, electronic communications between her, and her affair partner as evidence of the affair. It never went to trial, but she did drop her claim for alimony. That’s probably the closest I’ll ever get to an actual admission though.

If she’s degrading you to the kids, talk to a lawyer and see if you can reopen custody in juvenile court so that a guardian ad Litem gets signed. They’re your kid’s lawyer and will talk to the kids. If the kids tell him all the bad things mommy says but daddy doesn’t do that, you could potentially get more custody and while IANAL, you could potentially get her for contempt. The real problem with child support is that most of the mothers that get it look at it as supplemental income that they’re entitled to simply because they gave birth. My soon to be ex’s mother actually used back child support payment She got back in the day for cosmetic surgery. Wait until the divorce process starts and then the cops start randomly showing up due to “threats”. Before she even had a lawyer, I retained one and told him she was assuming she’d get full custody so he said we have to fight fire with fire and sued her early in juvenile court for custody. In my state all custody issues have to go through a Guardian Ad Litem and they cost less money in juvenile court than they do in civil court so he mainly did it to save me money.
