2	My Partner and I Have Agreed to Divorce but... Based on you description, no, you should not have any liability for your wife’s student loans following divorce, unless you co-signed her loans. In California, student loans are generally not apportioned to the non-debtor spouse in the context of divorce. In fact, if you have paid down any of your wife’s student loans with your wages/salary or anything else that could be considered “marital property,” you might be able to seek some reimbursement from your wife.
