I’ve seen it done in states with more progressive laws. In WA state for example, the child support is calculated on income but also the amount of parenting time to both parties.

There’s so many variables to answer those questions. As Gattsama said, you can’t and shouldn’t serve your own spouse. Most lawyers will hire a process server. There’s what is legal and what is practical. One day or two out of the home is fine. Anything beyond that looks like abdicating the property and custody to your wife. People may be traumatized in the process, but only you can weigh the choices between what’s legal and what’s right. Just know though, that taking the high ride in divorce is almost always an obstacle for the things you ultimately want.

If you have an ID and a bill statement, call the police. If you are on the mortgage you have a legal right to be in your own home. If the cop tells you to leave anyways, ask for a copy of the report to submit as evidence you tried. This not legal advice.

I do know that my lawyer had advised one weekend a month for my daughter to be with her mother so that I’d have at least one weekend a month off. That might be something you could arrange unless you feel like your ex will use it to get more custody.

I would consult a lawyer. That’s way above anyone on this subreddit’s pay grade. I know my lawyer here in WA told me that spouses are only able to obtain half of what your put in while you were married. That can also be balanced out with other financial concessions.

You believe your ex? I don’t believe a thing our exes tell us. I believe the courts and law papers. If you haven’t been served yet, she may be bluffing or behind. File first with everything you want. The courts only care about who files first and how reasonable and accommodating you can be as a husband and father. Also, if the bank account is in your name only she can kick rocks.

I would sit down and calculate everything. That includes the future. The longer you stay with her, the bigger her share of “joint property” gets. So estimate the cost of divorce now vs 10 years from now. That includes child support, alimony, house,retirement, etc.

Thanks dude. I plan on setting an example of compassion and not putting up with the impossible anymore. We are in reconciliation from me trying to leave the mom, but she begged me to stay saying she would get help. It’s been 8 weeks and no therapist and/or medical help. If IN is an equitable property state then she is entitled to half of your pension that you paid into while married to her. My lawyer told me that you are able to negotiate with other incentives to have her leave the pension alone such as more money back from sale of the house, etc. It’s worth it for me if I want to retire before 70.
