The result of this is that the accuser will stick to their guns more often. That could work against real rape victims though and cause them to withhold a real accusation, since if the rapist doesn't get convicted, they could try to frame it as a false accusation. Even if it actually happened, and they got off due to insubstantial evidence, it's hard to prove an accusation is true or false, one way or the other.
