You haven't misinterpreted anything in your own excitement. That's just a nice way of saying you'll have a clear predictable indication you're not committing rape. You should want whoever you sleep with to be excited to sleep with you, not a pity lay. Yes, it's great, but it ignores reality. I mean, would you say all "pity lays" are rape then? Even between husband and wife? Consent is more about a person's reasonable beliefs based on all of the circumstances.

The discussion that needs to happen is about consent, this isn't a competition. Excited consent should be the only consent, and that is for both parties. That's just as bad as saying unequivocal non-consent ought to be the only non-consent for both parties.

The key fact that makes this unlikely to be rape is: I felt scared and shy. He didn’t do anything to scare me. I just felt too scared to say stop. Generally, if the plaintiff claims fear prevented her from objecting or resisting, the plaintiff must prove the defendant's actions and conduct were reasonably calculated to induce this fear in the victim's mind.

Rape is heinous crime—it's overwhelmingly committed by men against women. However, most men aren't rapists and most rapes aren't a matter of "being THAT guy." If a poster were to say something like "If she can't walk, she can't consent: Don't be THAT guy" then I don't think many here would have a problem with it because it doesn't treat the majority of men like rapists, it just says that some guys are 'dinks. A poster like that would be extremely patronizing. It's directed to all "guys," and it addresses them like criminals. "Don't rape" posters might be appropriate for certain segregated groups where rape is extremely common like the military or pris…

I am sure girls could have better throwing form then they stereotypically do now if they practiced more. They would still pitch "worse" though. Jennie Finch's fastest pitch in the 2004 Olympics was 71mph. Good male softball pitchers throw in the mid-80s.

This is a neutral criminal law being applied on a disparate basis between men and women for the same crime, i.e., having sex with a minor. This is only a dumb equality argument if you think equal protection is dumb.
