my bad, I meant that in utah they'd both be charged. she would definitely not be free. there's a specific case I'm thinking of where this 7 year old kid did a 9 year old girl (something like that, I forget the exact ages, both were under 15, it was a couple years ago, made national news) and they ruled that they had statutorily raped each other and made them both sex offenders. It all depends on the state, though in most, your point stands.

I think it's because she was 15 -- if he had been 1 year younger he probably wouldn't be a registered sex offender, but it also depends on the state. If that were in Utah, they'd definitely both be sex offenders.
