I don't know about what percentage of lawyers would be willing to take the case on a contingency fee basis but a guy I know got ripped off 90k and he spent thousands to sue his former attorney. Yes, he ended up getting the money back plus his court costs but only AFTER he was able to prove that he got ripped off.

That is allowed by statute, put into place by legislatures, and not by attorneys or judges. True but a big chunk of the Congress/Senate is made up of lawyers so why would they pass legislation that would cut down their own? You're obviously biased as an attorney.
