The courts will assume that you have done whatever the petitioner claims. The result is a system that basically makes state-assisted extortion a profitable business for those filing the lawsuits. I would argue that far too many contemporary claims do not even deserve acknowledgement, much less the tens of thousands of dollars in attorney fees required to successfully defend against them. There is virtually nothing to lose from filing a frivolous lawsuit, but the odds are that the state will help…

The fundamental problem with that standard is that it allows for guilty until proven innocent, and that is downright criminal. The courts deserve our contempt when the innocent are treated with contempt.

That may be theory. The practice is quite different. We have almost completely abandon "innocent until proven guilty" in the courts, most notably in civil cases. The difficulty now lies in backing away from this abyss.

I am a tall skinny man with very long hair. I once got catcalled by a dude driving past in a pickup truck.
