A small correction: in most states, there is no right to a grand-jury indictment, and the US Constitution's guarantee of that right (in the Fifth Amendment) has not been held to apply to state prosecutions. So a case may be brought to court by a prosecutor, rather than by a grand jury. I appreciate the comment. I put that section in brackets at the end for a reason; I could (and perhaps should) have left it out. I'm writing a followup post in which I discuss some empirical evidence in support of the proposition, rather than just asking my readers to rely on their own experience of the world.
