Be agreeable and soft make him feel like you are there to help and make things easier not there to suck all the resources out of the room and leave. In an assault case most of the time the victim has to press charges. In some jurisdictions the police can press charges on behalf of the victim but that is not the norm. In murder case the victim can't speak for themselves so the state reserve the right to do that for the victim.
