1	Hmmm Back in the day-day ulit was automatically the mother. Now all states disregard gender and leave it to the parents to decide. Most of the time BOTH the mother and father agree that the child/children would be more fit to be with the mother especially in their tender years. If both parents want custody then the child (or each child) if within a certain age can decide who they want to go with. most the time they really cant decide so all parties agree on a joint custody or partial custody.
