I have two boys full time, full time job, no child support (It basically offsets Alimony) and I can tell you it can be challenging.

Depends on the state, but in general, you split all assets and debts acquired during the marriage. In this scenario, you'd probably want to make sure the debts are assigned to her, get your name off the lease, and have everything offset with other assets. In my divorce in California, we ended up using the amount of my 401K she was getting to offset other things. Source: I'm in no way a lawyer.

If you are actually 50/50 each taking one is probably the easiest way to go. If you want this you should specify it in the divorce agreement. If you do not specify it then from a tax perspective the parent that the child spends 50% + 1 nights (it's overnights not the amount of hours or anything else) gets to claim them.

Not a lawyer in California. When I was looking into it, the only benefit would be that it would be easier to legally become married again to the woman I would be legally separated from. I went the divorce route.

It is a terrible state to divorce in. That being said, for Alimony, they have a standard formula, and over 10 years, it does give a date, but you don't have to agree to it. A judge could technically set it more, less, or not at all and in theory you both could agree to whatever you want. I have a buddy getting divorced here and she wants no alimony, so that is the agreement attached to the divorce settlement. Mine waned what she was legally entitled to, so she is getting about 9 years for a 13 y…
