This is going to be pretty state specific. And in all my reading it doesn't matter who pays what bill or how much. Purely income. If she doesn't work I'd drag counseling out as much as possible and try to get her working again. Otherwise you can have an income imputed to her based on her potential earnings. More of a gray area you could potentially seek lower paying employment but I'd be cautious of that.

Usually there is a calculator on the state website, I would start plugging in some numbers and see what it looks like. Technically yes you're over 50 50 and that should reduce your payments. I also recommend officially volunteering to cover other kid costs like school, clothes, activities, insurance etc as that should also be taken into account to reduce what you have to give her monthly. If she's still with the affair partner you may be able to take advantage of the "affair fog" and offer her a…

Child support isn't optional. She can come back with her hand out at any time later and the State will enforce it. I recommend keeping the house as that is "home" for the kids. You also keep the bus stop for when they are in school. I see my kids 12 out of every 14 days because they come here to get on the bus in the mornings even when it isn't "my" day then I get to get them off the bus too = more time with me above the technical 50 50 split. Spouse support is generally temporary depending on l…

Yes, every day they are not with me I call around bedtime to see how their day was and tell them goodnight. This was written into the agreement. Ive missed only a day or two over a few years. Their Mom calls most of the time but not always. Older kid got a phone now so I call them direct and don't have to interact with their mom now so that's nice.

Thankfully my ex didn't fight me too much on this, I would get threats that she would go for full custody but that's all they were, threats. Those continued for a few years even after the papers were signed. I caught her in the affair fog as well initially so that probably helped as she just wanted away. We lived together for some months after the announcement but started a 50/50 schedule as soon as she moved out. I insisted on this to set precedent. It was mostly amicable when she saw $$$ and b…

I would, and did, keep the house. Not only for a stable familiar place for my kids but also because I knew eventually the value would rise further and that would help me later in life. My kids also get on the bus here, even on days which aren't officially mine, so I see them more than if I would have had to move out of the school district even if it is only an extra 15-30 minutes a day, that time adds up.

I never post but our situations are similar including location and income levels of self and ex spouse. I am a few years out and it has all calmed down and I got a VERY good deal. First do not increase your income until after things are final. If you are taking OT stop, do not change jobs, do not get a promotion, do not get a 2nd job, or start a business. In fact I would give the impression that things are hard, work is slowing down, etc. I went pro se and submitted evidence of my pay stub and m…
