Tying this to the Lochte case (another case of lying to the police), they are being prosecuted for the inconvenience to the Police because they didn't accuse anyone of the crime. (One of them was fined $10800 already). But in Brazil, actually naming someone in the complain to the Police carries 12 times the sentence. Because of the damage to their reputation. I see what you mean, but see it from the point of view of a judge: they can't abolish the law completely, but they can make it a little bit less insane. About you point: anything above 14 for the age of consent is absurd, because teenagers will actively seek sex with older people.

Our laws also say there's got to be more than 6 years in age difference for the crime to happen, which is another protection. Age of consent is 14, but a 18 year old can have sex with a 12 year old and someone that is 19 can have sex with a 13 year old. It isn't in Brazil: the judge has to take account of the age the girl appears to have (we don't use a jury for rape cases). The accused can use the defense 'she looked like she was older': there's precedent of girls actively trying to look older because they wanted sex with older people, and it wasn't ruled as statutory rape, because the accused wasn't expected to look at documents.

No, they may have a slightly bigger chance, which is completely different from "proven". Going to a family that has a bigger chance of being problematic is still better than staying in foster care, as that really is certain to be a problem. Even if they were abusive, they would be better than foster care. You can only say horrible things like this because you have no idea what foster care is like. What you need to compare is being adopted by 2 moms or 2 dads against foster care, which for sure will mess up the kid. It isn't because man are better at raising children, but it is true. When the father is absent, in most cases it's because he left or is in jail, leaving the mother alone with the kids. Dad's will raise children alone usually when the mother dies, at birth or soon after. It isn't very surprising that children from less troubled backgrounds grow better.
