To be completely honest, I don’t like the phrasing of the quote. In a legal sense, absolutely, yes: evidence is needed. But if you are raped, there’s not necessarily going to be evidence. That doesn’t mean you can’t talk about it with friends and family in order to help you work through the experience.

This would be pure speculation. Agreed, I am speculating, but I don’t think it’s baseless. Given what was said, it seems like a life sentence was the probable outcome until they considered his sexuality. today, judges [do] the sentencing. According to the ABA, “In most states and in federal courts, only the judge determines the sentence to be imposed. (The main exception is that in most states juries impose sentence in cases where the death penalty is a possibility.)”

The verdict was fair. The sentencing wasn’t. It was increased because of his sexuality. If you believe in the death penalty, that’s fine. Your issue should then be that a straight man in the hands of the same jury would have dodged the death penalty because of his sexuality.
