If I can be guilty of drunk driving (or rape!) while I'm drunk, then someone equally drunk is entirely capable of making their own decision about whether or not they consent to sex. Theres a big difference between having active sex with a drunk woman and molesting someone who's passed out. The latter is clearly over the line, both legally and morally. This is clearly not targeted at violent rapists - it wouldn't have any effect on them anyway. This is targeted at "date rape" - largely non violent, often not even especially coercive, with "aggressors" who wouldn't even realized that they had "raped" someone. What's wrong with good old "no means no"? This ad places the burden of testing their partners state and mood on the man - all men. Personally, I think we extend the "rape" label too far into "I made a poor decision" territory, but that's were it is right now. A man can be charged, tried, and convicted of rape if he has sex with a woman who is later considered 'too drunk' to consent. Even if he was equally drunk.
