I just think that human rights in employment law is extremely important (for some obvious reasons), but having the wrong perceptions of how it works is bad for everyone. If they find no evidence, you get a "right to sue" letter. Without that letter, you can't just file. You're thinking of general civil ligation. The complaint goes before the EEOC and/or state human rights commission for review. The process can take up to 2 years and you only need to sue if you lose at the agency level - then that's another 2 years. Just so people know for future reference, if you're ever a job applicant or employee who is discriminated against in a situation like this (or know someone who is) - you should file a discrimination complaint / lawsuit.
