Congratulations on skipping right over the main point of the post. Did you even read what I said? Did I dispute the 34% figure? No. And as you as you seem to know a great deal about this stuff, it's not unreasonable at all to arrive at a child support payment of $1200 - in fact, it's damn easy. How he started with $80 is odd. To the person who posted the comment that child support is capped at 34%, you're not too bright. First of all, the 34% is calculated on GROSS income. So, it's quite feasible that after taxes and child support, he loses one paycheck per month. But then again, child support is tax free to the CP, so it doesn't suprise me that they "forget" this. Right, so it's only exempt from garnishment activity, not the support or maintenance orders themselves. Even though it's not garnished, the obligations remain.

The numbers are certianly not suspsect if he's getting $500 to $1000 in monthly disability (which is a reasonable assumption) in VA disability, under the marital conditions described, and with numerous children. And at least you're no longer holding your original implication that his va disability income is exempt from child support withholding. It is my understanding, there are practically no exemptions for child support (that I know of). I've sent some emails out asking for clarification. However, this is certianly not the first case where this has happend with a Vet. The story claims that the mother was a stay at home parent, even during the father's service time. Nope. It is true. And as a parallegal, you should also be aware that there are many ways to attach VA, social security, and disability benefits for child support and alimony. It depends on the State.
