Personal inconvenience certainly outweighs all other concerns, for the victims of and an overabundance of self-importance, I'll grant you that.

Seems like most folks are probably pretty tired of covid in general, sure, no argument there. It's also not a very big ask to put on a mask to enter a building while there's a pandemic on. The bigger issue is that for people generally on the edge in the best of times this just tilts them over the edge on the mental health issues. She seems to be having some kind of breakdown and taking it out on retail employees who are being asked to enforce these policies.

I concede the health code point, they can, however, refuse service based on their company policies which can (and do) change at any time- which is a more correct way of stating my original point. To your original contract point, I'm positive that's written into the contract.

None of this negates their ability to set safety standards. No shoes, no shirt, no service.

I mean truly it's a step above "thoughts and prayers". Not much, but a step.

I mean. That would kind of be poetic justice? Poor Anthony.

I have paid and received child support - let me tell you sometimes when you get that check and have been neglecting yourself so you could buy food for your kid because your shithead ex stiffed you for months it's nice to replace that pair of work pants and get a couple work shirts for yourself. It's not as cut and dry as you might think.

As a former police officer, I beg to differ. You take an oath of service. If you are a sworn peace officer you have an obligation to enforce the laws of your particular jurisdiction, report and investigate crimes and complaints, protect and serve the standards of justice. That being said, there are bad cops out there who shirk this duty, and even very bad cops who make personal decisions to commit crimes themselves. Even the police need policing.

I tend to agree with Pierce, specifically in this case they did not establish both moral and legal guilt to murder on the part of the girl in question. I would agree with OThomson that IS the case if you're speaking about something lesser, false police report for example. I appreciate your input - it's good to hear from different perspectives on an issue as volatile as this one can be.

Grab a pitchfork! I disagree, but you're welcome to your opinion.

The problem here is, "what if" you only have circumstantial evidence as they rape happened beyond what a rape kit, or other physical evidence is available. As I said, a good portion of genuine rape cases are reported beyond - if it cannot be proven to be a genuine rape through physical evidence, I am struggling with how this doesn't turn into bulldozer for the rape victim and a chilling effect for the whole system of reporting? How do you propose to prevent that from happening?

Ok, I'll bite - define the penalty Reckless Endangerment?

"moral certainty" please explain - if you mean "factual certainty" that the accuser intended to cause harm to the victim of the false rape charge then I agree with you.

You'd have to state a specific example for me to agree with that, there's probably 100 factors involved in something as circumstantial - for example age and mental state of the victim, did the victim resist at any time, etc etc - that's way too broad of an argument.

I'm not actually defending her, I'm defending the law. Personally I think she's a pretty awful example of a human being - but she's not a murderer. Defamation of character, false police report, absolutely, murder, no.

Motive is only 1 element of a crime - Mental state or "Mens rea", combined with the criminal act "Actus reus", must occur by the same person to be guilty of a crime. Thus, the girl was not charged with a crime. Again, while frustratingly morally reprehensible - the girl did not commit the crime of murder.

Why not have involved the police? There were other options freely open, the attacker made a decision, by intent or by moment of passion, the motivation up until that moment was by the girl, however after that decision it was 100% the attackers decision to murder.

You're assuming that the person who stabbed is an automation, without a mind or conscience, that man killed the victim.

I believe in letting a guilty man go over imprisoning a innocent man, that's how justice works sometimes - it's the basis of innocent until proven guilty, reasonable doubt, and affirmative deference to a crime (castle law, self defense, etc). That this girl didn't care and was "recklessly indifferent" to the persons life is morally reprehensible, but not a crime. Much like standing idle as a person is assaulted is not a crime if you do not have a "duty" to intervene (as a peace officer would) th…

I have to disagree she did not cause the death of the boy. While absolutely horrible, despicable, and downright stupid - you'd have to prove that she intended for the boy to die as a result of her false accusation. To the greater issue, should false rape claims be punishable by some kind of justice - yes, absolutely. A 2-5 year Felony for claiming false rape charges should be passed in all states. Additionally, in cases of underage of consent cases, if it's proven a false rape report occurred th…
