It is quite clear about sole custody. It states she must provide: Court order specifically permitting applying parent's or guardian's travel with the child and Judicial declaration of incompetence of non-applying parent She will need to see a judge to get that passport. You should be invited to the hearing. Regardless of all that talk to a lawyer.

You have to sign passport paperwork. Does your daughter already have a passport? If she does you can request a hearing in the court your custody agreement was created in to try and stop her from leaving the country. If you have visitation you wont' have access to the child if she isn't here. Technically that will be a violation of the agreement. Anyway, because this is not a win for the children it is not a win for anyone. I agree with this but its not the Father's fault the Mother ran off with the kids. She put them in this situation. You can't just take kids on a vacation and never return. The mother caused this. If the father did that he'd be locked up for kidnapping. This is absolutely a men's right's issue.
