Your wife sounds like my ex. The house belongs to your parents, therefore will not be a part of the divorce no matter how much she says she will drag it into the picture. Don't give her a cent. My ex tried similar tactics, but got nothing. I would suggest getting financial statements on every account you have going back at least a year, then opening a new bank account in your name only. Any direct deposits should go to the new account. No direct contact, only through lawyers. Good luck.

Absolutely. My ex had $170k in student loan debt and tried putting me on the hook for that. A good lawyer will get you cleared of that. If they are really good, they could tie that doctorate into a higher earning potential and give your ex less in the division of assets. (You did not state your education or earning potential)

California, in the Central Valley. Yes, $5k was all it took. Retirement, house, alimony at stake. She didn't touch my retirement, I paid no alimony, she sold the house for the profit, but left with nothing after I informed a creditor of the pending sale and her windfall. They took every cent of that.

IANAL, but if you each have a vehicle, she won't touch the car anyways. Same goes for your inheritance, especially since he has not passed, but most states do not allow a spousal claim on inheritance. As for your savings, it would depend on how much you had saved prior to marriage, same for pensions. Don't do this unless you are getting away with no other things like alimony, child support, or other lingering payments to her. If that is the case, and she wants to buy you out, demand that the house either be refinanced to her name or sell it outright. My ex tried getting me to pay the mortgage for six months after the divorce was final so that she could refinance it in her name, but it would never happen (she had a $170k devt judgement against her).

My ex tried that to the tune of $15k. She had to eat that, as the day I filed made her responsible for everything after that point. Once I found out about her plan, I closed all joint accounts.

If you have a house that you used a VA loan on, make sure it's fully taken care of in the proceedings, including who gets it, if refinancing is a requirement and what timeframe, or what timeframe is required to sell the home. My EW tried getting slick, but I torched her lawyer before the settlement hearing. EW had to sell the home, which freed up my VA loan.

I busted her lawyer before the settlement hearing because her loan servicer had sued her for not making payments. I whipped out that letter and told her lawyer that she wouldn't ever be able to refinance the house due to her judgement, and that she was only entitled to.about a quarter of my retirement. Mine quit a good paying job, went to minimum wage, and demanded alimony, half of my military retirement (despite only being married to me for half of my career), wanted me to pay the mortgage for six months while she refinanced, didn't want to buy me out on the house, and wanted me to pay half of her debt. No kids. In the end, I had her agree to sell the house and keep the profit ($110k because she sold for far under market value), no alimony, we kept our respective retirements, and our own debt…

I offered to pay off student loans she opened with me as cosigner, she sells the house and keeps the $170k profit (houses are selling in 3 days or less at 10% over asking). I agreed to pay the mortgage for two months after the divorce to aid in the sale. Currently in a similar divorce, but finally got her to agree to my terms. She wanted to buy me out, but after slapping her lawyer with mail that came to my new address, she realized that she couldn't possibly be approved for a home loan. I have a retirement that she wanted half of, but after her lawyer saw through her lies, she understood that the initial deal I offered was more than she could ever negotiate. After four months and a settlement hearing, she caved in.

When it is discovered that a claim was made up, they should get the same penalty that the person being charged would have received. It might help curtail many of these frivolous claims and claims that incite hate and violence.
