Sorry, just gotta say this one additional thing - you can spread/get oral herpes even if the person doesn't have an outbreak/cold sore! (Some of us learned that the hard way...) If someone has herpes, they experience some amount of asymptomatic viral shedding - they shed the virus from the infected site but don't have any symptoms. First of all, it's oral herpes, so you can tell people you get cold sores, and you won't have nearly as much stigma to work with. I'm not saying you should not disclose that it's herpes, but because you can call it cold sores/aka herpes, I really truly think that makes a difference (coming from someone with genital herpes). Settlement is definitely preferred, it's cheaper for everyone. My main concern is whether or not someone has the funds to retain an attorney and pay all the fees associated with a lawsuit, AND whether the other party has any money to make them worth going after. Since the person you'd be suing is your former employer and not your employer, you'd be looking for money where there probably isn't much (unless that ex-worker is independently wealthy). Lawsuits always sound like a nice idea, but in reality, they don't usually pay off, so usually aren't your best bet. That being said, he should document everything possible! Because we live in such a litigious society, it is especially important for men to protect themselves from these frivolous situations.
