To be fair, we don’t know that she didn’t. The pic is taken from a sheriffs office.

That's a fair point. I guess innocent until proven guilty would be true for both cases...that you didn't rape, and that you didn't purposefully make a false rape accusation. Both statements can be true given how grey the line can be. That said, I'm not as concerned about what the courts will do versus what people think the courts would do. Adding additional levels of fear into a court case would scare people away from prosecuting, even if it's not factual. I'm open-minded to change. Obviously so…

I'm speaking conceptually as well. If you have any links to the experts you're referring to, I'd be happy to read up on it.

So I agree. However, the courts are never that black and white. Passing a rule like this would be extremely beneficial to rapists with good lawyers. Say you rape somebody at a party, with nobody to see it. She steps out, takes you to court. Your attorney gets rid of any evidence so it's just your word vs hers. Now she's going to jail for stepping out against a powerful figure. I'm not offering any solutions, btw. I'm just saying that long jail time isn't really the answer.

Yes. Maybe it'll teach him not to stick his dick in crazy.

I have a hard time with this. On the one side yes, she should, but actual rape victims have it hard enough. If there is insufficient evidence in an actual rape case, I don't want that to cause somebody to not step forward out of fear of then going to jail.

That.

You can kill a man, but you can't kill an idea.
