Without a custody order, in most states, she can do what she's doing with no consequences. See above comment re: file custody first and file restraining order first.

Couldn't agree more. Don't react, don't answer her calls. Even if you think you're not reacting, she could perceive (or fabricate) an unpleasant reaction. Texts are good, but yes or no answers are best when possible. Difficult to misinterpret when (not if) she drags those records into court. Whomever files first has a significant advantage. File first. Call the police. Not that they'll do anything, even with a custody order, but it's at least documented that way. Lawyer up. If you can't afford to lawyer up, call Legal Aid and get their assistance before she does. Conflcit of interest means if you "retain" them first, they can't represent her. My thoughts and hopes are with you, experience says you have an uphill battle.

My wife concurs, this is idiocy. Nevermind that there's a massive gulf between a "nonconsensual" playground kiss and rape. Nevermind that children at that age are entirely egocentric, and their world does not generally include how other people feel - that's why we teach them. Even if the author was spot on, his four year old will not remember a thing five minutes, much less five years, from the conversation.

Touché. I certainly could have chosen a better sub, but it is still relevant. Our society presumes that a victim or alleged victim is entitled to recompense from someone, no matter the cost to them, and no matter if that money could have gone towards fixing the mess of a system and a society we currently have. It's both. Men (people) handle this sort of thing in different ways. Some mock or use humour to lessen their own pain. Wrong though it may be, it's frequently effective. Some use it to claim status, which seems to me to be a worse offence.
