Ideally these types of issues would never rise to the level of formal action. But as commented above when a persons pay becomes at risk there is very little option but to protect your financial interests. It may be the case where this individual is absolved of all wrong doing in the end but it would be a terrible thing to go bankrupt in the process. It maybe the case that he is being treated unfairly. Perhaps if he was a white male he might not be on leave without pay. Who knows?
